Welcome to TrenchRecon (“we,” “us,” or “our”), a multitool platform for memecoin analysis, powered by artificial intelligence and accessible via our Telegram bot, web application, and Discord bot (collectively, the “Services”) at trenchrecon.com. By accessing or using our Services, you agree to be bound by these Terms and Conditions (“Terms”), our Privacy Policy, and the terms and policies of third-party technologies we utilize. If you do not agree with these Terms, you must not use our Services. We reserve the right to modify these Terms at any time, and continued use of the Services after such changes constitutes your acceptance of the updated Terms.

1. Acceptance of Terms

By registering for or using the Services, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with all applicable laws and regulations. These Terms constitute a legally binding agreement between you and TrenchRecon.

2. Description of Services

TrenchRecon provides AI-powered tools for analyzing memecoins, including blockchain data analysis, online presence evaluation, and scam or rug pull detection. The Services are accessible through:

• Telegram Bot: The primary interface for registration, membership management, and interaction with AI analysis tools.
• Web Application: A complementary platform for users with active memberships, accessible via the “Login with Telegram” feature.
• Discord Bot: A community-based interface for AI interactions, available during the Beta Program’s third phase. To use the Services, you must register through the Telegram bot to activate a membership. The web app and Discord bot are only accessible to users with an active membership. The AI retains user query history across platforms using a shared database (storing chat IDs, usernames, etc.), ensuring seamless cross-platform context sharing.

The Services are currently in a beta phase, meaning features may change, and bugs may occur. We offer a Beta Program for selected users, providing one month of free access to test features across Telegram, web app, and Discord. After the beta period, a subscription fee applies.

3. Membership and Payment

a. Membership Registration

You must initiate membership by interacting with our Telegram bot at https://t.me/trenchreconbot. Registration requires a Telegram account, and you authorize us to collect data as outlined in our Privacy Policy.
Memberships are available in different tiers (e.g., Basic, Pro, Enterprise), each with specific features, interaction limits, and pricing, as detailed during the registration process.

b. Payment Terms

• Payment Method: Membership fees are paid in cryptocurrency via the Telegram bot. Payments are manual and must be initiated by you every 30 days to maintain active membership status.
• Payment Responsibility: It is your responsibility to renew your membership by making a payment every 30 days. TrenchRecon does not automate payments, and failure to pay will result in suspension or termination of access to the Services.
• Non-Refundable: All membership payments are final and non-refundable. Once a payment is made, you receive access to the Services for the corresponding 30-day period, regardless of usage.
• Pricing Changes: We reserve the right to modify membership pricing at any time. Changes will be communicated via the Telegram bot, email (info@trenchrecon.com), or our website, and will apply to subsequent payment cycles.

c. Membership Suspension or Termination

Your membership may be suspended or terminated if you fail to make timely payments, violate these Terms, or engage in prohibited activities.
Upon termination, access to the Services will be revoked, but certain data may be retained as outlined in our Privacy Policy.

d. Beta Program Participation

We are currently running a Beta Program, offering 25 selected users one month of free access to test the Services across three phases: Telegram bot (1-2 weeks), web app (1-2 weeks), and Discord bot (1-2 weeks). To apply, visit https://trenchrecon.com/beta-program/. Selected testers will receive instructions to join our private Telegram group for beta coordination. Beta testers are expected to provide feedback on bugs, features, and performance, and active testers may earn perks (e.g., extended subscriptions, VIP status) based on engagement, as determined by TrenchRecon. The Service may experience bugs, downtime, or data loss during the beta phase, and we are not liable for such issues.

4. User Responsibilities

a. Account Security

You are responsible for maintaining the confidentiality of your Telegram account credentials, as our Services rely on Telegram’s authentication.
You must notify us immediately at info@trenchrecon.com if you suspect unauthorized access to your account.

b. Accurate Information

You agree to provide accurate and complete information during registration and when using the Services, including payment details and memecoin data for analysis.

c. Compliance with Laws

You must use the Services in compliance with all applicable laws, including those related to cryptocurrency transactions and data protection.

d. Prohibited Activities

You may not:

• Use the Services for illegal purposes or to facilitate fraudulent activities.
• Attempt to reverse-engineer, hack, or interfere with the Services or their underlying technologies.
• Share your membership access with others or use multiple accounts to bypass interaction limits.
• Submit false, misleading, or malicious data to our AI tools.
• Engage in any activity that disrupts or harms the Services, other users, or our third-party providers.

5. Third-Party Technologies

TrenchRecon relies on third-party technologies to deliver the Services, including:

6. Intellectual Property

All content, software, and materials provided through the Services, including AI analysis tools, designs, and documentation, are owned by TrenchRecon or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes during your active membership. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.
Additionally, you retain ownership of content you submit (e.g., token addresses, queries). By submitting content, you grant us a worldwide, royalty-free license to use, store, and analyze it to provide and improve the Services.

7. Disclaimers

a. No Financial Advice

The Services provide AI-powered analysis for memecoins, but this is not financial, investment, or legal advice. You are solely responsible for any decisions made based on our analysis, and we do not guarantee the accuracy, completeness, or reliability of the results.
Cryptocurrency investments carry significant risks, and you should conduct your own research before making decisions.

b. Service Availability

We strive to maintain uninterrupted access to the Services but do not guarantee availability, as interruptions may occur due to maintenance, technical issues, or third-party provider limitations.
We are not liable for any losses or damages resulting from service interruptions or inaccuracies in our AI analysis.

c. Third-Party Data

Our AI tools rely on blockchain data, online presence data, and user inputs, which may be incomplete or inaccurate. We are not responsible for errors in third-party data or user-provided information.

d. General Disclaimer

The Services are provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We reserve the right to address any circumstances not explicitly covered in these Terms at our discretion, in accordance with applicable laws.

8. Limitation of Liability

To the maximum extent permitted by law, TrenchRecon, its affiliates, and its third-party providers shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or cryptocurrency, arising from your use of the Services. Our total liability for any claim shall not exceed the amount you paid for your most recent 30-day membership period (or $0 for beta testers).

9. Indemnification

You agree to indemnify and hold harmless TrenchRecon, its affiliates, and its third-party providers from any claims, damages, or expenses (including legal fees) arising from your misuse of the Services, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may terminate or suspend your access to the Services at any time, with or without notice, for reasons including but not limited to non-payment, violation of these Terms, or suspected fraudulent activity. Upon termination, your right to use the Services will cease, and we may delete your account data, subject to our Privacy Policy.

11. Changes to Terms

We may update these Terms at any time to reflect changes in our Services, legal requirements, or business practices. We will notify you of material changes via the Telegram bot, email (info@trenchrecon.com), or our website (trenchrecon.com). Your continued use of the Services after such changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Services.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in English in a mutually agreed-upon location. You waive your right to participate in class actions or collective arbitration. Claims for injunctive relief or intellectual property disputes may be brought in a court of competent jurisdiction.

• No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force Majeure: TrenchRecon is not liable for delays or failures in performance due to events beyond our control, including but not limited to natural disasters, cyberattacks, government actions, or third-party service outages.
